This Addendum applies only when you choose to supply your own parts for a service performed by Carvero Auto Care LLC d/b/a Avero Mobile Auto Care ("Avero"). It supplements, and is part of, your Repair Authorization and the Service Terms (Section 7.4).
You request that Avero install the Customer-Supplied Parts listed in your Repair Authorization. After reasonable inquiry, you confirm that the manufacturer, brand, part number, description, source, and stated condition of each Customer-Supplied Part are accurate. You must disclose whether a part is used, remanufactured, rebuilt, previously installed, returned, opened, modified, damaged, incomplete, or subject to any known recall or safety warning, and you must provide available packaging, instructions, and proof of purchase on request.
You are responsible for selecting the specific part and requesting its installation unless Avero selected or specified that exact part in writing. This Addendum does not shift responsibility to you for incorrect written part-selection information supplied by Avero and reasonably relied upon by you.
Avero may conduct an ordinary visual inspection and compare labels, dimensions, part numbers, application information, and apparent fitment. Unless separately stated in the Repair Authorization, this does not include destructive testing, internal inspection, materials testing, engineering analysis, or independent verification of authenticity. Avero's inspection, acceptance, or installation of a Customer-Supplied Part is not a certification or warranty of that part's authenticity, design, manufacture, quality, durability, internal condition, or freedom from latent defects.
Avero will not knowingly install a part that it reasonably believes is incorrect, incomplete, visibly damaged, recalled, incompatible, or unsafe, and may decline or stop installation if such a condition is discovered.
Because Avero did not sell the Customer-Supplied Part, Avero does not provide or adopt any warranty concerning the part itself. Any warranty, refund, return, or defect claim concerning the part must be pursued by you with the part's seller, distributor, or manufacturer. Avero is not responsible for handling a supplier return, shipping a part, obtaining a replacement, advancing the cost of a replacement, or administering a third-party warranty unless Avero separately agrees in writing.
Unless diagnosis is specifically included in the Repair Authorization, your request to replace a particular part is not a diagnosis by Avero, and Avero does not promise that installing that part will correct a symptom or underlying vehicle condition.
Avero's applicable Limited Workmanship Warranty continues to cover whether the authorized installation was performed with reasonable care and workmanship. Your provision of a part does not, by itself, eliminate that coverage.
A failure is not a covered workmanship claim to the extent it results from the Customer-Supplied Part itself, including an inherent or latent defect, incorrect application, mislabeling, counterfeit condition, incompatibility, prior use or repair, modification, contamination, missing hardware or instructions, or inaccurate material information you supplied. When the original installation was proper, Avero's workmanship warranty does not provide a refund of the original labor or payment for repeat labor, diagnosis, travel, towing, rental transportation, replacement parts, shipping, or other costs resulting from failure of the Customer-Supplied Part.
If a Customer-Supplied Part is incorrect, defective, incomplete, or unsuitable, Avero may be unable to begin or complete the requested service. You remain responsible only for labor, diagnosis, disassembly, reassembly, travel, or other work that was actually performed and specifically priced or authorized in the Repair Authorization or an approved Change Order. You will not be charged for work that was not performed. Any additional labor, replacement part, return visit, diagnostic service, or other charge will be separately quoted and authorized before it is performed or supplied.
If you reasonably believe the vehicle may be unsafe after service, you should stop driving as soon as safely possible, arrange towing when appropriate, notify Avero promptly, preserve the relevant part and packaging, and give Avero a reasonable opportunity to inspect before non-emergency corrective work is performed. This does not require delaying emergency action necessary to protect people or property. A failure to preserve evidence or provide an inspection opportunity affects a warranty determination only to the extent it materially prevents a fair determination of the cause.
This Addendum defines the scope of Avero's contractual workmanship warranty and the charges associated with Customer-Supplied Parts. It is not a release of claims arising from Avero's negligent selection, handling, or installation of a part; Avero's failure to exercise reasonable care concerning an apparently incorrect or unsafe part; gross negligence, recklessness, or intentional misconduct; fraud or misrepresentation; or violation of an applicable statutory or regulatory duty. Nothing in this Addendum waives or limits any right or responsibility that cannot lawfully be waived or limited under New Jersey or federal law.
